WHO IS RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA
Nostos Mykonos Yachts is responsible for the processing of your personal data. Please note also that our payment provider(s) process personal data collected through our site upon purchase and are independently responsible for their processing.

WHO CAN GAIN ACCESS TO YOUR PERSONAL DATA
Your personal information is processed primarily by us at Nostos Mykonos Yachts. We will never sell or rent your personal data to third parties. In some cases, we share your personal data in order to fulfil our obligations to you in a good and efficient manner:
- In order for us to ensure that you pay us, our payment provider(s) will gain access to your personal data.
- We may pass your information to our third party service providers, agents subcontractors and other associated partners for the purposes of completing tasks and providing services to you on our behalf (for example to send you mailings). However, when we use third party service providers, we disclose only the personal information that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own direct marketing purposes.
- To market relevant services and to make our website as relevant as possible we share your personal data with those providing us with a marketing service including such as Google and Facebook.
- We will share your personal data with IT suppliers that process the personal data on behalf of us as processors to assist us with IT-services.

DO WE TRANSFER YOUR PERSONAL DATA OUTSIDE OF THE EU/EEA?
Nostos Mykonos Yachts generally process your personal data within the EU/EEA, but in a few cases we use suppliers from countries outside of the EU/EEA. When transferring your personal data outside of the EU/EEA, Nostos Mykonos Yachts will ensure there is an adequate level of protection.
Nostos Mykonos Yachts may transfer your personal data to the USA or UAE and our supplier that provides a service for sending newsletters and our suppliers that provides services for marketing relevant services and to make our website as relevant as possible.
Any US associates we may use have certification according to Privacy Shield. Privacy Shield is an agreement between the EU and the USA, which rationale is to protect the fundamental rights of Europeans and to ensure legal certainty for businesses transferring personal data to the USA. American companies are able to sign up to be Privacy Shield certified with the U.S. Department of Commerce. Such department will then verify that the suppliers’ privacy policies comply with high data protection standards.

HOW TO AFFECT THE PROCESSING OF YOUR PERSONAL DATA
According to data protection legislation, you are entitled to a variety of rights in order to affect our processing of your personal data. Read more below.

That is the case for example when the accuracy of the personal data is contested by you, or the processing is unlawful, and you oppose the erasure of the personal data and instead requests restriction of its use.
- The right to data portability— you have the right to ask us totransfer certain of your personal datawe have about you to another company (data portability) and reuse your personal data for your own purposes across different services. This right applies to personal data that you have provided us in a structured commonly used, machine-readable and interoperable format if:
- The processing is based on consent or on a contract and
- The processing is carried out by automated means.
In exercising your right to data portability, you have the right to have personal data transmitted directly from Nostos Mykonos Yachts to another controller, where technically feasible.
- The right to object— you have the right to, entirely or partly,withdraw a given consentfor the processing of your personal data. Your withdrawal will have effect from the time of your withdrawal. You have the right to object to our processing of your personal data. You always have a right to object to marketing from us, such as newsletters.
- Rights in relation to automated decision making and profiling— you have the right not to be subject to a decision in respect to automated decision making and profiling.
- The right to lodge a complaint to a supervisory authority— if you consider that your rights are violated in any way, you have the right to lodge a complaint with a supervisory authority (Hellenic Data Protection Authority). You may do this in particular in the EU/EEA member state of your habitual residence, place of work or of an alleged infringement of the applicable data protection laws. In Greece, the supervisory authority is the Hellenic Data Protection Authority. This right is without prejudice to any other administrative or judicial remedy.
- Identity confirmation: In case of doubt we can request additional information to verify your identity. This serves to protect your rights and private spheres.
- Misuse of rights: If you execute any of these rights too often and with obvious intent of misuse, we may charge you an administrative fee or decline to process your request.
HOW AND WHY WE PROCESS YOUR PERSONAL DATA
In general, the personal data we store and use has been given to us either through a personal interaction with guests and trade partners (for example during a cruise) or as a result of a specific inquiry or booking. We do not buy personal data databases. We only process personal data that you have chosen to share with us and we only use your personal data in accordance with applicable laws.
We process your personal data in the following circumstances:
- To perform the service you requested as per the contract entered into with you or with a party representing you (i.e., travel agencies, tour operator and destination management companies).
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. Legitimate interest is a technical term in data protection law which essentially means we have a good and fair reason to use your data and we do so in ways which do not hurt your interests and rights.
- To comply with a legal or regulatory obligation.
HOW LONG WE KEEP YOUR DATA
We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
Where we process personal information for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data so that we can respect your request in future.
WHERE IS YOUR DATA STORED
Your personal data will be stored and processed both inside and outside the company facilities. Where personal data is stored and/or transferred outside of the company it will be managed and handled in accordance with GDPR. We reassure you that we will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.

WHAT IS A COOKIE

1. BACKGROUND
1.1 These general terms and conditions (the “General Conditions”) apply when you as a client (the “Customer”) place a booking via www.nostosmykonos.com, email, third party agent(s), web platforms, and related pages, (the “Website”). Detailed contact information and other information about Nostos Mykonos Yachts are set forth on the Website.
1.2 The Customer must be minimum 18 years old to book or/and contract our company. Nostos Mykonos Yachts does not, in accordance with Greek and EU law, accept any credit purchases to persons below 18 years of age. Nostos Mykonos Yachts reserves the right to deny or change a Customer’s booking (e.g. if the Customer has provided incorrect personal data and/or has any record for non-payment of debt).
1.3 Nostos Mykonos Yachts shall have no liability in case of image or typographical errors of the services on the Website, e.g. errors in the yachts’ description or technical specification, inaccurate prices and price adjustments. Nostos Mykonos Yachts is entitled to rectify any such errors and, at any time, to change or update the information. All images on the Website shall be considered solely as illustrations. Such illustrations do not guarantee to reproduce the exact appearance of the yachts. Nostos Mykonos Yachts is not responsible for any information by third parties provided for on the Website.
1.4 The Website and all its content is owned by Nostos Mykonos Yachts or its licensors. The information is protected by intellectual property and marketing legislation. This means that trademarks, company names etc may not be copied or used without the prior written consent of Nostos Mykonos Yachts. Even though images and graphics, design, layout and information about services and other content may be downloaded, copied or used without the consent of Nostos Mykonos Yachts.
1.5 Nostos Mykonos Yachts does not own or license any Other-Party Intellectual Property. Nostos Mykonos Yachts does not in any way make any representations or warranties about Other-Party Intellectual Property associated with Nostos Mykonos Yachts services. The Customer is solely responsible for determining the need for and, if appropriate, obtaining any needed Other-Party clearance, consent, or release to use any Other-Party Intellectual Property in his creations.
2. BOOKING, CONTRACTS AND CANCELLATION
2.1 In order to contract with our company, the Customer must accept the General Conditions. By accepting the General Conditions, the Customer undertakes to comply with the General Conditions in its entirety and acknowledges that he/she has read the information on personal data and cookies and consents to the use according to Nostos Mykonos Yachts’ Privacy Policy set forth here.
2.2 Bookings are accepted on the basis that the details provided by the Customer are accurate and true.
2.3 The Agreement between you and Nostos Mykonos Yachts will only be formed when the written confirmation of the booking is dispatched. The charter rate balance payment, if any, is payable one week before embarkation. Should you book less than one week before departure then the full rate of the charter is payable upon booking.
2.4 In case you request to alter the booking is made, Nostos Mykonos Yachts will try to arrange alterations, but may have to charge an administration fee. If no alternative can be arranged the original Agreement will stand.
2.5 All cancellation requests must be made in writing and received prior to the departure date and will be effective on the date it is received by us together with all travel documents by then issued to you. If the cancellation is made at least 30 calendar days prior to the cruise date, the customer is entitled to a 50% refund of all payments made until then. If the cancellation is made at any later date, the customer is not entitled to any refund amount.
3. PRICES AND PAYMENT
We reserve the right to vary the price of any charter should we consider it necessary through a fluctuation in exchange rates although no changes will be made within 30 days of departure. Only increased costs caused by Government action will be passed on after this time.
4. SPECIAL OFFERS
Nostos Mykonos Yachts may from time to time provide special offers on the Website which may have more favourable conditions than those set forth in these General Conditions, e.g. with regard to payment or extended right of withdrawal. Such conditions will apply for the duration of the special offer and for the specific yachts set forth by Nostos Mykonos Yachts in connection therewith. Nostos Mykonos Yachts reserves the right, at any time, to withdraw such special offers. Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments. Any offers on specific services on the Website are valid only for a limited period of time and until services are sold out.
5. OUR RESPONSIBILITIES
We undertake to exercise all due diligence to ensure that the charter booked by you is provided in accordance with our contract, we accept responsibility for any loss or damages caused to you as a result of the negligence or default of our company or any member of our team (associates).
6. COMPLAINTS
We hope you will have no cause for complaint but if you do, then a written complaint must be sent to us as soon as possible after the end of the charter and not later than ten days, after which no claim can be entertained.
7. DAMAGE / SECURITY DEPOSIT
You are liable for any damage to the yacht, its equipment or third party damage. Assessment of the damage will be made and the appropriate amount could be deducted from the security deposit, if any. If no security deposit has been received, the Customer is still liable for paying the full amount required to rectify the damaged caused. We will take reasonable steps on your behalf to arrange for the balance of the deposit to be returned to you as soon as possible after the charter and usually within ten days. However, should damage be caused as a result of wilful negligence by the Customer or as a result of not obeying the instructions of the Company’s staff, then he or she will be liable for the full amount or replacement. Adults will at all times be responsible for the actions of minors in their charge.
8. LINKS
Nostos Mykonos Yachts may provide links to other websites beyond the control of Nostos Mykonos Yachts and websites beyond the control of Nostos Mykonos Yachts may provide links to the Website. Even if Nostos Mykonos Yachts attempts to ensure that Nostos Mykonos Yachts only provides links to websites which apply similar personal data and security provisions pursuant to Nostos Mykonos Yachts’ Privacy Policy, Nostos Mykonos Yachts is not responsible for any protection or confidentiality of information or personal data which the Customer provides on other websites. The Customer should be cautious and read the personal data provisions applicable to the actual website.
9. FORCE MAJEURE
9.1 Nostos Mykonos Yachts is not liable for any delays caused by circumstances beyond Nostos Mykonos Yachts’ control, e.g. general labour dispute, acts of war, fire, epidemics / pandemics, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power / telecommunications / computer communications or other communications and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in the relief of Nostos Mykonos Yachts from rectifying potential damages, or from taking other measures.
9.2 Nostos Mykonos Yachts reserves the right to withdraw or cancel the yacht at any time prior to departure for reasons of serious damage to the yacht, hostilities, civil strife, strikes, threats of war, closure of airports, terrorist activities, epidemic / pandemic or any other reasons amounting to “force majeure”. In this eventuality, Nostos Mykonos Yachts will endeavour to give as much notice as possible and refund all monies paid less reasonable expenses. We reserve the right to make alterations to a booking and to substitute services or yachts which the client has booked. In the event of making such alterations we will endeavour to give the client as much notice as possible and to arrange for comparable services or yachts or to obtain a part or refund all monies paid less reasonable expenses. Any alterations do not entitle the Customer to cancel the charter.
10. CHANGES TO THE GENERAL CONDITIONS
Nostos Mykonos Yachts reserves the right to change these General Conditions at all times. Any changes to these General Conditions will be posted on www.nostosmykonos.com. Changes will become valid once the Customer has accepted the General Conditions (in connection with a new purchase or while browsing the Website), alternatively ten days after Nostos Mykonos Yachts has informed the Customer of the changes. However, Nostos Mykonos Yachts recommends that the Customer regularly remains updated on www.nostosmykonos.com in order to become aware of any changes to the General Conditions.
11. SEVERABILITY
If any provision of the Agreement is held to be invalid or unenforceable by any competent court, authority or arbitral tribunal, the remainder of that provision and all other provisions will remain valid and enforceable to the fullest extent permitted by applicable law. Any provisions determined invalid or unenforceable will be substituted by relevant legal guidance and advice.
12. APPLICABLE LAW AND DISPUTE RESOLUTIONS
The Agreement is governed by the laws of Greece. Any disputes shall primarily be settled by agreement after discussions with the Nostos Mykonos Yachts customer service department. If an amicable settlement of the dispute is not possible, it will be settled by the Courts of Athens, Greece by application of Greek Law.
